Terms of Service

This is an English translation for convenience. If it differs from the Japanese version, the Japanese version prevails.

These terms set out the conditions for using KiritoriAI (the "Service"), an automatic video clipping service. By using the Service, you agree to these terms.

1. The Service

The Service finds lively moments, such as laughter, in a video you choose and makes clips that include what came before and after them. Loading the video, turning its sound into numbers and cutting the clips all happen inside the browser on your device. Only numbers describing the loudness and how much the sound resembles laughter are sent to our server to decide what to cut. For moments that are hard to call, those numbers are sent to an external AI (JevAI) for a second check.

2. What the Service is for, and uses we don't intend

The Service is meant to save you the work of finding and cutting highlights from recordings you made yourself or have the right to clip (such as game calls with friends, archives of your own streams, or gameplay videos).

We do not intend to help anyone clip and publish other people's streams, shows or videos without the rights holder's permission. If a streamer or creator publishes clipping guidelines, please follow them. We are not responsible for any disadvantage you suffer from use that breaks such guidelines or the rights holder's permission.

3. Accounts

• You are responsible for managing the email address you registered with.
• Do not share your account with anyone else.
• We may suspend an account without notice if we find misuse.

4. Coins

• The Service works by buying and spending "coins".
• Clipping one video uses the total of:
  • 20 coins per minute of video (partial minutes are rounded up)
  • 13 coins per 1,000 tokens of the checking AI (up to 20 checks per video; 0 if no moment is hard to call)
• When the server decides what to cut, we set aside the maximum expected amount, and return the difference once the cut is decided. If server processing fails, we return the amount for the video length and only charge for the AI checks actually used.
• If the cutting step on your device fails after the ranges are decided, the coins used are not returned. Within 24 hours you can re-cut the same result with different settings (lead-in and ending) for free.
• Coins do not expire. Coins are not refunded once added, except where required by law.
• We may change the rates and the sign-up bonus. Changes apply from when they are posted on this page and do not affect coins already added.

5. Prohibited conduct

When using the Service, you must not:

• process videos, or publish clips, that break the law or public order and morals
• use the Service in a way that infringes others' rights (copyright, portrait rights, privacy, etc.)
• clip and publish other people's streams, shows or videos against the rights holder's permission or the creator's clipping guidelines
• publish clips that hurt, or expose the private life of, people who appear or are heard in a recording, without their consent
• interfere with the Service or put excessive load on it through automation
• avoid billing by analysing or reverse-engineering the Service, or tampering with the numbers it sends
• copy, resell or redistribute the Service, or use it to offer a similar service
• register with false information or pretend to be someone else
• do anything else we reasonably judge to be similar to the above

If we judge that you have done any of the above, we may suspend your account, void your remaining coins or take other necessary steps without notice.

6. Your responsibilities

• You confirm that you have the rights needed for the videos you process, and that your use of the clips does not infringe anyone else's rights.
• If friends or other people appear or speak in a recording, get their agreement before publishing clips of them.
• How you use or publish the clips is your own decision and responsibility.
• If a dispute arises between you and a third party about your use of the Service, you will resolve it at your own responsibility and cost.

7. Your videos and clips

• Videos are loaded and cut on your device. We do not send or store your videos, audio or clips on our server.
• Clips exist only in your browser until you save them. They disappear when you close the tab or choose another video, so please save any clips you want to keep.
• The numbers and records we receive are described in our Privacy Policy.

8. Intellectual property

Intellectual property rights in the programs, screens and other works that make up the Service belong to us or their rightful owners. We claim no rights in your videos or your clips.

9. Disclaimer

The Service is provided as is. Because lively moments are detected automatically, we do not guarantee that every moment you expect will be clipped, or that no unwanted moments will be included.

We are not liable for damage you suffer from the following causes that are not attributable to us:

• outages, delays, changes or failures of external services we use (cloud platform, checking AI, payments, email, the network that delivers the video tools, etc.)
• processing failures caused by your device's performance, free memory or browser
• loss of unsaved clips, for example by closing the tab
• natural disasters, changes in law, network failures or other force majeure
• your breach of these terms

Despite the above, if you suffer damage due to our intent or gross negligence, we will compensate you for it.

Only where you suffer damage due to our minor negligence, our liability is limited to the total amount you paid us in the 12 months before the damage occurred.

10. Changes, suspension and end of the Service

We may change the Service, or suspend it temporarily for maintenance or failures.

If we end the Service, we will post a notice on this page and email you at least 30 days before it ends. Purchased coins remaining at that time will be handled as required by law.

11. Minors

Minors must get consent from a parent or legal guardian before using the Service, including before buying coins.

12. Exclusion of anti-social forces

You represent and warrant that you are not, and will not become, a member of an organized crime group or other anti-social force. If this proves untrue, we may suspend your account without notice.

13. No transfer

You may not transfer, pass on or pledge your position or rights and obligations under these terms, including coins, to any third party without our prior written consent.

14. Notices

We contact you by email to your registered address or by posting on the Service. If a message does not reach you because of a problem with your email address, it is treated as delivered when it normally would have been.

15. Severability

If any provision of these terms is found invalid or unenforceable by law, the remaining provisions stay in effect.

16. Changes to these terms

We may change these terms within the limits of the law. When we do, we will post the new terms and the date they take effect on this page before that date. If a change is to your disadvantage, we will also email you. If you use the Service on or after the effective date, you agree to the changed terms.

17. Governing law and jurisdiction

These terms are governed by the laws of Japan. Any dispute about the Service is subject to the exclusive jurisdiction of the Yokohama District Court as the court of first instance.
